[영어 원문] The first question that seems to me is why do this at all, and it’s a relevant question because as Korea is learning now and as any jurisdiction that’s tried this will learn quickly, it is extremely hard. It involves a great deal of negotiation and compromise between partners who, at least in our system, are natural adversaries. It involves almost inevitably some sort of a tug of war between the prosecution representatives on any commission and the judicial representatives neither which, neither of whom want to give up what they understand to be their entitlement in terms of the discretion they exercise in a system. And to do it right, it requires kind of an agreement of all of the parties that it is worth giving up some of that for the greater good whatever the good is that you are seeking to achieve with your system. So in our jurisdiction in the District of Columbia, I should say, I meant to say that when I speak of the system in Washington DC, I mean the contrast that with the system Judge Sessions spoke about this morning. Ours are not the federal sentencing guidelines. They are much more akin to anyone of these other state systems. It’s just a system that operates in the District of Columbia as an independent jurisdiction like one of the states. Back in the 80s really, and again in the late 90s, a number of us, when I say as I mean judges but not solely judges had grown quite concerned about what we perceived to be almost certainly unwarranted disparity in our sentencing system. The sentence that was imposed depended to a greater extends; an extend to with which we were quite uncomfortable on the judge that your case happens to be assigned to, and similar cases seem to be sentenced quite dissimilarly without any obvious explanation for the differences.
