After the judge has in accordance with the steps 1 to 3 as described above examined and established the specific statutory penalty range which is applicable to the specific case, the final assessment of the concrete punishment has to take place.  The criteria or factors for this assessment are provided by section 4 to 6 of the criminal code.  And it reads “the basis for the assessment is the guilt of the offender.  When determining the guilt, the court shall consider in particular the following factors:  the motives and aims of the offender, the model disposition disclosed by the act, the extent of violation of duty, the manner of execution and the effects of the act, the offender’s prior history, his personal and financial circumstances, and finally his behavior after the offense particularly his efforts to make restitution for the harm caused by him and his efforts to reach reconciliation with the victim.  The effects which the sentence can be expected to have on the offender’s future’s life and society shall also be taken into account.
