[영어 원문] I want to go over very quickly in the time I have some of the principles that we built into our system. First and foremost, our guidelines from the beginning, our advisory, our voluntary, that mean judges are not obligated to follow them in individual cases, and a judge’s decision not to follow the guidelines is not reviewable on appeal. We’ve had two cases now from our court of appeals, where judges have declined to follow the guidelines, or in one case, it was argued that judges tried to follow the guidelines but did so incorrectly. And in both cases, the court of appeal said that that’s none of our business, the guidelines are voluntary if the judge gets it wrong the judge gets it wrong, if the judge decides not to use them that’s the judge’s prerogative. Nobody else on my commission was in favor of that. And its prosecutors and defense lawyers argued strongly for only a voluntarily advisory system.
