미국법상의 아동양육

이 글은 아동(Child)의 자립을 지원하는 넓은 의미의 ‘양육’(Child - Rearing)에 대하여 미국을 중심으로 검토하였다. 

부모는 자녀를 양육(Child - Rearing)함에 있어서 우선권(The Parental Preference Doctrine)과 자치권(Parental Autonomy)이 인정되며, 이는 헌법상 보장된다. 다만, 부모가 아동을 온전히 양육할 수 없는 경우, 그 권한은 제한되거나 종료될 수 있다. 친권이 종료(Termination of parental rights)하면 부모는 더 이상 아동의 양육에 참여할 수 없으며 그 권리가 회복될 수 없으므로, 친권을 종료시키려면 그 사유가 있음을 분명하고 설득력 있게(clear and convincing) 입증하여야 한다. 친권이 종료되지 않는 한 부모는 아동의 양육에 일정부분 참여할 수 있고, 후견인(Guardian)이나 양육자(custodian)가 부담하는 책임(powers and responsibilities) 정도에 따라 그 권리(rights)가 제한된다. 즉, 부모가 생존하고 있는 경우에도 부모, 후견인, 양육자가 함께 아동을 양육할 수 있다.

Child - Rearing under the US Law

This paper aims to examine child-rearing from a viewpoint of support to children's independence. Especially, it places emphasis on American children.

American parents are guaranteed to exercise two child-rearing rights 'the Parental Preference Doctrine' and 'the Parental Autonomy' by the US Constitution. If parents do not rear their children properly, the two rights can be limited or terminated. If the termination of parental rights takes effect, parents in question cannot participate in the rearing of their children and recover those rights any more. In order to terminate parental rights, the government is to make clear and convincing the reason for the termination. If the limitation of parental rights is effect, parents in question can take part in bringing up their children partially but their rights are limited according to powers and responsibilities of guardians or custodians. That is to say, parents, guardians and custodians can rear children even in the case that parents of children in question live.
