[영어 원문] ○ George Cardona Yeah, I mean I don’t think I have an answer. I don’t think any of us have an answer for that question. But I think some of it depends, and some of it the differences between DC system and the federal system depends on whether you go with a charge-based system or a real offense based system. In a charge base system such as the DC has, basically the charge that the person pleads to, and hence the charge that the prosecution has chosen to charge and take a plea to, basically defines the sentencing range. And I think if you looked across the country you will probably find that in most charge-based system the ranges were broader. And part of that is and part of the reason that the sentencing commission rejected that when they went to different system that I will talk about in a second, was there was a view that gave prosecutors too much power in terms of determining what the sentence would be because what charged the prosecution selected would essentially define the sentence that was imposed if the range was very narrow. The sentencing commission rejected that in favor of a hybrid between a charge-based and a real conduct based system. And so and the federal system, the charge, the charge that the person pleads to, defines a base offence level. But then, the court itself looks to the underline facts of the crime and all the relevant conduct to then make adjustments to that offense level based on what the court determines to be the actual criminal conduct. So the court has some fact finding role, and some discretion there, and then the ranges are narrower. And that’s a trade off, I mean that is a tradeoff. That was a trade off that federal commission made, and a tradeoff that probably needs to be thought about it terms of how you set up your guidelines.
