[한국어 원문] 본 연구에서는 이러한 ICG 보고서의 내용을 중심으로 우리나라 집합투자기구가 조약혜택을 적용 받기 위한 국내세법에서의 선행 과제를 정리하고 있다. 먼저, 우리나라도 향후 조세조약의 체결이나 개정에 있어서 집합투자기구를 규정화하여 집합투자산업의 법적안정성을 확보할 필요가 있다. 둘째, 조세조약상 집합투자기구의 안정적인 법인격 적용을 위해서는 세법이 투자신탁에 대하여 법인격을 부여하고 ‘과세될 수 있는 구조’를 취하도로 하는 세법 개정이 필요하다. 셋째, 집합투자기구를 이용한 조약남용을 방지하기 위한 제한적 요건을 규정하는 입법론적 보완이 필요하다. 넷째, 집합투자기구가 조세조약상 인인 거주자에 해당하지 아니하여 조약혜택의 요구가 어려운 경우에는 투자자 또는 그 대리인이 직접 조약혜택을 요구할 수 있는 세법상의 보완이 필요하다. 다섯째, 국내 법인세법상 집합투자기구에 대한 외국납부세액 공제 대상에 있어서 투자자가 외국인인 경우에는 적용을 배제하거나 일정 한도를 정하는 방법이 필요할 것이다. 마지막으로 공모와 사모, 증권투자와 부동산투자 등의 집합투자기구의 특성별로 구분하여 과세를 차별화하는 새로운 접근방법도 집합투자기구에 대한 국제조세 선진화에 기여할 것으로 여겨진다. [영어 번역문] This research aims to suggest the six assignments precedent regarding the domestic tax law for Korean collective investment vehicles to be benefited by the tax treaty, based on the above-mentioned report. First, the legal stability of a collective investment industry is required to be secured by making provisions on collective investment vehicle in case of the conclusion or revision of a new tax treaty. Second, it is required to revise the tax law so that it can endow investment trust with juridical personality and enable the trust to ‘have a structure to be taxed’ in order for juridical personality to be applied to collective investment vehicles by the international tax treaty. Third, the legislative complementary measures are required that stipulate restrictive conditions against an abuse of collective instrument vehicles by the tax treaty. Fourth, required are supplementary measures of the tax law that enable an investor or his or her agent to claim the granting of treaty benefits in case that collective instrument vehicles are not benefited by that treaty in that those vehicles do not meet the requirements of a personal resident. Fifth, required is a measure which exempts foreign investors from the subject of the amount deducted from tax paid to foreign countries regarding collective vehicles according to the domestic tax law of juridical person or determines a fixed limit. Finally, it is as contributing to the development of international taxation regarding collective investment vehicles that a new approach which classifies those vehicles into public and subscriptions, and securities and real estate investments, etc. by characteristic and differentiates taxation is considered. |
