I can’t speak with very much authority on the US sentencing commission and its sense of independence, but I can talk about our own. In my jurisdiction, actually we have two legislatures that we have to answer to. We have local legislature for the District of Columbia and then if the Congress of United States doesn’t like what they do, they can overrule it. So when we write guidelines we are writing with one eye on a local legislature and the other eye and they point in very different direction sometimes on the US congress, and have to make sure that we haven’t done something that one legislature or the other will think it is either too lenient or too harsh or flawed for other reasons. We have been able to maintain our independence primarily by the mechanism of the humanity of our commission that has pluses and minuses. It produces the system it’s already been shown to have very wide ranges, wider than what some people may think are ideal and they are that wide because we wanted to get prosecutors and defense lawyers and victims rights to have the advocates and the sentencing experts and academics all to agree that it is a good system, and when you have that, as I have had, since 2004, we can go to our legislature and say, “here it is. If you want to change it, that’s of course up to you, but you should know that our prosecutor, our defense bar, our citizen advocates, our academics, and all the judges think this is the best we can do. And you change it at your peril.” The opposite of it is also true. If we do not have consensus, there are members our commission who can go to legislature and say, “you should see what these people have done, if there are people who, there are prosecutors who can go to a particular member of the legislature, there are defenders who can go to different member of the legislature, and if the legislature chose it any time, they can put us out of business. It’s really that simple, but they have no real incentive to do that if we are presenting them with a responsible product that gives them cover in a way, because they can say the commission did it. And that’s also an advantage from a legislator’s point of view.
