[영어 원문] There also is a stronger reaction from congress to actually direct the sentencing commission to do certain things, certain changes and that raises the much larger specter, is to how independent we are. Does the legislature have the ability to impact the work that the commission does by its directives. And the situation in the United States is they do. They do it by way of a mandatory minimum sentencing, and they can do it by way of directives to us to increase penalties in some particular ways. And those are responded. We are in fact an independent agency within the three branch government, but we need to respond to all the branches of the government and when there are directions, we respond. So it raises the question about whether a sentencing commission can remain totally independent of the legislature and totally independent of the executive branch. Well then, so, congress is much more interested in directing a commission in various changes and then the sentencing and then the Supreme Courts of the United States issued a series of opinions which are, when right to depart the sentencing guideline structure. And I told you a mandatory guideline structure. Judges must follow the guidelines. The Supreme Court said that the guidelines should no longer be mandatory. They are merely advisory. And I will tell just briefly described to you how they did this. This is essentially a very strong statement about judicial discretion and authority over sentencing. What they essentially said, you look at our guideline system you will see various points or the seriousness of the offense, and then there will be added points based upon the circumstances. Did you use a gun? Did you hurt anyone? Various other factors. And those all increase the sentence of the points and ultimately the sentence. What the Supreme Court said was that if you do that, if you have a mandatory structure, and you have a, in within that structure, a way of increasing the penalty, every defendant have right to jury trial. And that is the tradition. So whenever a judge wanted to increase the range because the defendant used a gun or shot somebody or did something else which warranted in increasing penalty, that defendant at sentencing will be entitled to a jury trial and you can’t imagine how difficult it would be to apply a jury trial to all of the factors that judges think about when they impose the sentence. So the way the Supreme Court went around the issue about jury trial was to say the guidelines are now advisory and they are no longer mandatory on judges.
