Now we try to address the main question of how uniformity in sentencing is secured and how much of uniformity is necessary and reasonable at all.  When doing so I would like to refer to the point of discussion provided by our host.  So what safeguard exist against other trial reductions of penalties.  Well the answer is similar to the answer given by my Japanese colleague.  The main safeguard is the possibility for the prosecutor to file an appeal.  I will give you further explanation on that point immediately.  Next question, are the sentencing rules or guideline that governs the prosecutor’s sentence, no, however, some informal standards have been established as to what is common.  Next question. How much weight is given to the prosecutor’s recommendation.  Well in practice often, the term of the sentence lies a little bit below the prosecutor’s request, also similar to Japan’s, I suppose.  How much discrepancy would give rise to an appeal. Well of course, a relatively wide gap would give rise to an appeal, for example if the sentence only for manslaughter instead of for murder.  But the prosecutor may also file for an appeal if the sentence is within the right statutory range but it seems to be lenient within this range.  You can find a real example in the annex of my written statement.  There in the case of rape, the court of appeal was of the opinion, that the court of first instance did not assess probably inter-lier the fear fed by the victim.  Also this fear criteria is most specific statutory aggravating circumstance.  So that’s it.  Only two pages more.
