불법...[소프트웨어복제에 관한 중학생의 위법의식연구1<논문초록한영번역][소견서번역]
한국어 원문 소프트웨어 복제에 관한 중학생의 위법의식 연구 이 연구는 중학생을 대상으로 불법복제 소프트웨어 이용실태를 파악하고, 중학생의 위법의식 및 행동을 분석하여 건전한 정보 활용방안을 제시하는 데 그 목적이 있다. 이용된 설문지는 중학생들의 불법복제 소프트웨어 이용실태, 위법의식, 인터넷중독, 사이버비행에 대한 척도로 구성되었다. 자료의 수집은 부산에 거주하는 중학생을 대상으로 설문조사를 통해 이루어졌으며, 총 310매가 회수되어 290매를 분석에 이용하였다. 회수된 자료는 SPSS version 16.0을 사용하여 분석하였고, 적용된 주요 통계방법은 빈도분석, 백분율 등의 통계분석을 실시하였다. 이 연구를 통하여 얻어진 결과를 요약하면 다음과 같다. 1. 청소년들이 불법복제 소프트웨어 이용실태에서 조사대상 중학생 290명이 불법복제 소프트웨어를 이용하고 있는 것으로 나타났다. 중학생들이 주로 불법 복제하는 소프트웨어는 MP3 (음악파일), 게임, 영화, 애니메이션․만화, 포토샵 등의 그래픽 프로그램으로, 불법 복제 소프트웨어 이용 중학생들은 학습용 소프트웨어보다는 주로 음악, 게임, 영화와 같은 여가용 문화 컨텐츠를 이용함을 알 수 있다. 중학생들이 불법복제 소프트웨어를 이용하는 방법은 인터넷을 통해 복제품을 무료로 다운받는 것이다. 중학생들이 불법복제 소프트웨어를 이용하는 이유로는 인터넷을 통해 복제품을 얻는 것이 간편성, 정품을 사서 쓸 경제적 능력이 없어서이다. 청소년들이 소프트웨어 불법복제에 대한 태도를 보면, 불법복제에 찬성하지는 않지만 경제적 능력이 없는 중학생들을 위해 불가피하다, 프로그램을 개발한 사람의 저작권 보호를 위해 당장 없어져야 한다 라고 응답해 불법복제 소프트웨어 이용에 대해 대체로 허용적임을 알 수 있다. 그밖에도 불법복제 소프트웨어를 앞으로도 잘 모르겠다, 계속 사용할 것이다, 사용하지 않을 것이다 로 나타났다. 또한 정품소프트웨어의 무단복제에 대한 생각으로 잘 모르겠다, 불법이다, 불법이 아니다 라고 나타나 앞으로도 중학생들의 불법복제는 계속 있을 것이다. 2. 중학생들의 불법복제 소프트웨어 이용과 위법의식 및 인터넷 중독, 사이버비행과의 관계에서 불법복제 소프트웨어 이용집단과 비집단간에 모두 상관관계가 높이 나타났다. 즉 비복제집단이 불법복제집단에 비해 위법의식 및 태도에 있어 긍정적으로 나타났고 불법복제집단이 비복제집단에 비해 인터넷 중독성향이 높게 나타났다. 또한, 불법복제집단이 비복제집단에 비해 사이버비행의 경험 빈도가 높았다. 즉 불법복제집단에 속하는 중학생들이 비복제집단의 중학생에 비하여 소프트웨어의 불법복제에 대해서 더 관대하였고, 인터넷 중독 정도가 높으며, 사이버비행을 더 많이 저지르는 것으로 나타났다. 불법복제집단의 중학생들은 컴퓨터와 인터넷의 사용시간이 비복제집단의 중학생들보다 상대적으로 길기 때문에 사이버비행의 위험에 노출될 가능성 또한 높다고 볼 수 있다. 반면에 컴퓨터에 대한 이러한 관심을 관련 자격증 취득과 경진대회 참여에 긍정적 효과를 나타냈으며, 장래에 IT관련 분야로의 진출의 희망정도도 높게 나타났다. 불법복제를 했거나 이용해 본 중학생들은 비복제집단의 중학생들보다 상대적으로 놓은 정보인식과 접근능력, 그리고 컴퓨터 이용능력을 보유하고 있음에도 법의식에 대하여 무관심하며 저작권 침해에 대해서도 관용적인 태도를 가지고 있다고 할 수 있다. 이러한 결과를 볼 때, 불법복제집단의 중학생들이 집중적인 정보 활용 기술교육과 저작권법교육을 받았을 때 IT관련분야에 진출할 인재로 자라날 가능성이 더욱 높다고 볼 수 있겠다. 그럼에도 불구하고 불법복제 소프트웨어 이용 중학생은 비행, 범죄로 연결될 가능성이 높다는 점에서 보다 높은 사회적 관심과 체계적인 대책의 수립이 필요하다고 할 수 있다. 중학생의 소프트웨어 불법복제 행위는 분명 위법이다. 중학생에게 소프트웨어와 디지털 컨텐츠의 특수성을 교육하고 지적재산권 침해의 문제가 단순히 저작권자만을 보호하기 위함이 아니라 21세기 지식정보사회의 기반요소인 소프트웨어 산업의 발전에 위해한 행위이며 더 나아가 국가적 목표인 정보화 선진국 진입을 막는 중대한 위협 요소임을 인식시켜야 할 것이다. 영어 번역문 A Research of Middle School Students' Illegal Consciousness on Copy of Softwares This research aims to investigate the real state of illegally-copied software use and to suggest a method for the sound utilization of information by analyzing middle school students' illegal consciousness and act. The questionnaire is composed of the real state of middle school students' illegally-copied software use and the yardstick for illegal consciousness, internet addiction and internet misconduct. This research conducted surveys of middle school students who reside in Busan for data collection. 310 questionnaires were retrieved and 290 questionnaires of them were used for the analysis. The data are analyzed using the SPSS version 16.0. This research applies methods such as frequency analysis and percentage to a statistical analysis. The outcomes of this research are summarized as follows. 1. The real state of middle school students' illegally-copied software use shows that 290 middle school students of the subjects use illegally-copied softwares. These softwares are mainly MP3 (music) files, games, movies, animated films and graphic programs (e.g. Photoshop, etc.). It can be inferred from this that illegally-copied softwares used by middle school students are entertainment softwares (culture contents) rather than softwares for study. The illegally-copied softwares are available as a free download from internet. The reasons for the use of the relevant softwares are a convenience of illegal copy and an economical ability not to buy retail products. Juveniles' attitude toward the illegally-copied softwares shows us that they do not agree to illegal copy but inevitably, they use those softwares for a financial reason. They generally accept the prohibition of illegal copy in that to the survey question on illegally-copied software use, they answered "Illegal copy must be stopped for protecting the programmer's copyright." In addition, they answered, "I do not know whether or not to use illegally-copied softwares.", "I will use illegally-copied softwares.", and "I will not use illegally-copied softwares." To the survey question on illegal copies of software, they answered, "I do not know.", "It is illegal.", and "It is not illegal." It is inferred from this that middle school students' will continue copying softwares illegally. 2. The relation between middle school students' illegally-copied software use and illegal consciousness, internet addiction and internet misconduct tells us that there is a high correlation between a group using illegally-copied softwares and a group not using illegally-copied softwares. That is to say, a group not using illegally-copied softwares take more positive view on illegal consciousness and attitude than a group using illegally-copied softwares and a group using illegally-copied softwares shows stronger propensity to internet addition compared to a group not using illegally-copied softwares. Further, a group using illegally-copied softwares has bigger frequency of experience of internet addiction than a group not using illegally-copied softwares. The relation shows us that middle school students of a group using illegally-copied softwares are more lenient about illegal copy, have higher level of internet addiction and conduct more internet misconduct, compared to the other group's students. Further, the relation tells us that middle school students of a group using illegally-copied softwares have greater possibility of being exposed to internet misconducts because they use computers and internet longer than the other group's students. However, this interest to computers exerts positive effects not only on these students' acquisition of the relevant qualification certificate and but also on their participation in competitions. Furthermore, the possibility of their future entrance to fields relevant to IT is shown greater. Students of a group using illegally-copied softwares are not interested in illegal consciousness and have a lenient attitude about infringement of copyright although they possess better recognition of information, abilities of access to information and abilities of computer use, compared to the other group's students. These results suggest that both an intensive technical training of information use and an education of copyright law provide middle school students using illegally-copied softwares with more opportunities to grow up as a talented person who will enter into the relevant fields to IT. Nevertheless, a social interest to, and the establishment of systematic countermeasure for, those students are more required in that they have a great possibility of the involvement in misconducts and crimes. Middle school students' illegal copy of softwares is clearly illegal. We are required to educate them a specialty of softwares and digital contents and to have them recognize that the issue of infringement of intellectual property rights is related not only to the protection of copyright holders but also to the development of software industries, a fundamental element of the 21st century's knowledge information society and the entrance into an informationized developed country as a national goal. |
